When things aren’t working with your spouse, you might be wondering what your options are. Many consider divorce to be the only way out, but it’s actually not the end-all-be-all. Legal separation is a court-ordered arrangement where a couple lives apart from one another, leading their own lives. It’s an alternative divorce method that achieves everything a divorce can, without being permanent.

If you’re unsure about whether you’d like to completely close the door on your marriage, legal separation offers a solution that allows you to take a step back and evaluate your options without immediately finalizing the end of your marriage.

No matter what the reasons for your separation are – religious, familial, financial, or something else –  this temporary resolution might be the best option for your situation. The good news is, you don’t have to worry about any influence from us. At New Leaf Family, our goal isn’t to rush you into deciding on divorce or even push you towards a legal separation if it isn’t the right choice for you. We seek to provide couples with the support and clarity they need to empower them to make the right decisions for themselves and their family.

If you’re considering your options for divorce, or for legal separation, call New Leaf Family today to schedule a free case evaluation and learn more about your options.

How Does Separation In Colorado Work?

To file for separation in Colorado, one spouse must have lived in the state for at least 91 days. If a couple shares children, they must have lived in the state for at least 6 months. Your petition for separation must also include grounds for separation, and since Colorado is a no-fault state, no specifications are required other than stating that the marriage is irretrievably broken.

The three-month waiting period is intended to give couples time to agree on the terms of their separation, such as custody, child support, and property division. If they can’t, the court makes the final decisions.

What Does Legal Separation Mean For Me?

  • You are free to live an independent life from your spouse.
  • You are still legally married. Should you decide to reconcile with your spouse, remarriage won’t be necessary. On the other hand, you cannot get married to anyone else while legally separated from your spouse.
  • You can file for separation from your spouse, even if they don’t agree to it.
  • You have a formalized arrangement for living apart while sorting out key issues.
  • You may continue to have access to certain marital benefits, such as health insurance coverage

At Every Stage Of Divorce, New Leaf Family Is There

Through our years of work, we’ve noticed that many other lawyers execute family law matters in a way that hurts families, more than it helps them. At New Leaf Family, you can trust that we aren’t here to “sell” you a divorce like it’s a one-size-fits-all solution. We know that our success comes from your success! We will take the time to listen to and understand your story, help you make the best decision for yourself, and ultimately find equilibrium once the dust settles.

Our separation and divorce attorneys are passionate about guiding couples and families through transitions like separation, whether it leads to reconciliation or divorce later on. Even in the face of adversity, conflict can be used as a tool for growth. At New Leaf Family, we focus on guiding you through these challenging times with compassion and understanding so that you can heal and move forward.

When you’re ready, call New Leaf Family to schedule a free initial case evaluation to determine your next steps.

Amber helped me significantly and not only that, but guided me through my legal journey. I would recommend 100%!! Ashleigh was amazing as well. They were both very communicative and professional. I have had many of lawyers and it was relieving that I had an attorney that was so genuine about her work and her clients. I will be using New Leaf Family Law if I ever need help with family court again. Thank you for everything.

Patti and Marc were great to work with. We lost my case on a technicality. However, I would choose them again to fight for me if I ever needed their help. New Leaf Family is a great firm to work with.
